New Laws Impacting Tennessee Motorcyclists

Tennessee motorcyclists will see the impact of the 2005 legislative session as several bills supported by CMT/ABATE, Concerned Motorcyclists of Tennessee/American Bikers Active Towards Education, become law on July 1, 2005. The legislation makes great strides in safety, motorcycle awareness among drivers and enhancement of the riding experience for 100,000 Tennessee motorcycle enthusiasts.
A first in the nation, the Tennessee Legislature passed SB0928 which allows the driver of a motorcycle or motorized bicycle to wear a “ventilated” crash helmet conforming to standards of specified testing agencies, “a label on the helmet shall be affixed signifying that such helmet complies with the requirements of the American Society for Testing Materials (ASTM), the Consumer Product Safety Commission (CSPM), or the Snell Foundation“. This type helmet, which allows the scalp to breathe through the vents, enhances driver comfort by eliminating the heat buildup of unvented helmets on hot days. Riding in a parade will be a lot more comfortable for Tennessee motorcyclists as helmets will be optional in organized parades under 30 MPH. Military veterans and active duty members now have the full range of specialty military license plates available to them including the Purple Heart and Silver Star license plates, previously available only for automobiles.
Legislation removing the motorcycle handlebar height requirement corrects a situation that found several models of major manufacturers bikes in violation as well as choppers from custom builders and owners.
CMT/ABATE worked with the Department of Safety to enhance motorcycle awareness with a billboard, bus-board and bumper sticker campaign, with billboards up in over 30 locations across the state and ad boards on Metro Nashville buses through early July.
